Making a request for access
26 Making a request for access
(1) An individual may request a
private sector person to provide the individual with access to
health information relating to the individual held by the
private sector person. A request must: (a) be in writing, and
(b) state the
name and the address of the individual making the request, and
(c)
sufficiently identify the health information to which access is sought, and
(d) specify the form in which the individual wishes the information to be
provided, being a form provided for by this Act.
(2) An individual who
requests access to health information relating to the individual may authorise
another person to have access to the information in the place of the
individual. Such an authority must: (a) be in writing, and
(b) name the
person who is authorised to have access to the information.
A
private sector person is to provide access under this Act in accordance with
any such written authority.
This section does not prevent an individual and a
private sector person from making other arrangements for access to
information: see section 32.
