Private sector person may require evidence of identity or authority
36 Private sector person may require evidence of identity or authority
(1)
Before a private sector person amends health information at the request of an
individual or an authorised representative of the individual, the
private sector person must take reasonable steps to be satisfied about the
authority of the person making the request to request amendment of the
information.
(2) For this purpose, the private sector person may require
evidence of: (a) the identity of the person making the request, and
(b) if
the person making the request claims to be an authorised representative of the
individual to whom the information relates, the authority of that person.
Note: The term
"authorised representative" is defined in section 8.
