53 Operation of certain other Acts
(1) The Public Service Act 1979 does not apply to or in respect of the
appointment of a member of the Commission or Conduct Division and such a
member is not, as a member, subject to that Act.
(2) If by or under any other
Act provision is made: (a) requiring a person who is the holder of a specified
office to devote the whole of his or her time to the duties of that office, or
(b) prohibiting the person from engaging in employment outside the duties of
that office,
that provision does not operate to disqualify the person from
holding that office and also the office of a member of the Commission or
Conduct Division or from accepting and retaining any remuneration payable to
the person under this Act as an appointed member of the Commission.
(3) The
office of an appointed member of the Commission shall for the purposes of any
Act be deemed not to be an office or place of profit under the Crown.
(4) The
Commission, the Conduct Division, the members of either body, the officers of
the Commission, the members of any committee of the Commission and any members
of the Police Force or other persons assisting either body are not subject to
the Ombudsman Act 1974 or the Police Regulation (Allegations of Misconduct)
Act 1978 so far as concerns anything done or omitted under or for the purposes
of this Act or purporting to have been done or omitted for those purposes.
(5) The Interpretation Act 1987 does not operate so as to authorise the
suspension or removal of a judicial officer from judicial office.
