Leases, licences and other estates in respect of community land-terms of 5 years or less
47A Leases, licences and other estates in respect of community land-terms of 5
years or less
(1) This section applies to a lease, licence or other estate
in respect of community land granted for a period that (including any period
for which the lease, licence or other estate could be renewed by the exercise
of an option) does not exceed 5 years, other than a lease, licence or other
estate exempted by the regulations.
(2) If a council proposes to grant a
lease, licence or other estate to which this section applies: (a) the proposal
must be notified and exhibited in the manner prescribed by section 47, and
(b) the provisions of section 47 (3) and (4) apply to the proposal, and
(c)
on receipt by the council of a written request from the Minister, the proposal
is to be referred to the Minister, who is to determine whether or not the
provisions of section 47 (5)-(9) are to apply to the proposal.
(3) If the
Minister, under subsection (2) (c), determines that the provisions of section
47 (5)-(9) are to apply to the proposal: (a) the council, the Minister and the
Director of Planning are to deal with the proposal in accordance with the
provisions of section 47 (1)-(8), and
(b) section 47 (9) has effect with
respect to the Minister’s consent.
