HEALTH RECORDS AND INFORMATION PRIVACY ACT 2002 - SECT 27
Response to request for access
27 Response to request for access
(1) A private sector person must respond
to a request for access within 45 days after receiving the request.
(2) A
private sector person responds to a request for access by: (a) providing
access to the information as required by this Act, or
(b) refusing access to
the information.
(3) A private sector person who refuses to give an
individual access to information must give the individual a written reason for
refusal of access, being a reason for refusal provided for by this Act.
(4) A
private sector person who charges a fee for providing access to information
need not provide access until 7 days after payment of the fee, if: (a) the
private sector person has given the individual written notice stating that
access will be provided on payment of a specified fee, and
(b) that notice is
given within 45 days after receiving a request.
(5) Access may be refused to
a part of the information to which a request relates (with access provided to
the remainder of the information).
(6) A private sector person is taken to
have refused access to health information if the private sector person fails
to respond to the request for access as required by this section.
